A Practical Problem Solver Dedicated to Resolving Disputes
Robert is intimately familiar with dispute resolution having worked for 28 years as a civil litigator. He was trained as a mediator in 2020 through the Alternative Dispute Resolution Program at Conrad Grebel College at the University of Waterloo and moved away from litigation practice in early 2021 to focus exclusively on providing mediation services to litigants and those in need of assistance with dispute resolution.
Robert brings to his mediation practice a wealth of experience litigating civil disputes. He started his career representing both Plaintiffs and Defendants in commercial actions and then spent over 26 years at two of Toronto’s most well established Personal Injury law firms representing victims of serious trauma in civil disputes. He has represented clients in first and third party motor vehicle actions, occupiers’ liability cases, medical malpractice actions, product liability actions and private disability insurance claims, and he has acted as counsel at over a thousand mediations in such actions. He has extensive court experience and is well respected by his peers on both sides of the Personal Injury Bar.
Robert’s familiarity with the relevant legislation, court practice, jury trials, and the insurers involved in various types of civil litigation provides him with the tools required to be an effective intermediary for litigants seeking to achieve resolution of their civil disputes in a fair and practical manner. He has the experience, temperament, work ethic and passion necessary to be the ideal catalyst to getting even the most difficult cases settled.
Robert’s Approach
Robert prides himself on being goal oriented, and has always taken a practical, big picture approach to settling civil claims which has made him extremely well suited to assist parties in resolving their disputes. He believes a mediator can only be effective if they take the time to properly prepare and review all the facts of a dispute, understand the competing interests, and work tirelessly to determine where common ground can be found to bring divergent viewpoints together. While many mediators will say the sign of a good settlement is both parties leaving a little unhappy, Robert believes the opposite to be true. Compromise and flexibility do not have to create unhappiness or disappointment, and they should not, if everyone participating in a mediation understands that compromise and flexibility are simply necessary elements to a mutually beneficial, properly negotiated settlement. Robert’s goal in every mediation he conducts, is to resolve the dispute to the satisfaction of all participants, and where resolution cannot be achieved, to provide a productive forum for the parties to hear and learn about the positions, concerns, interest and goals of others to help facilitate resolution of the dispute in the future.
Education & Affiliations
Robert graduated from the University of Toronto, with an Honours B.Sc. in Psychology in 1988. He then completed his LL.B. at the University of Western Ontario in 1991 and was called to the Ontario Bar in 1993. In 2020, Robert completed the Fundamentals of Dispute Resolution course at Conrad Grebel college, University of Waterloo. He is a member of the Law Society of Ontario, Canadian Bar Association ADR section and the ADR Institute of Ontario.
